These Terms of Service ("Terms") form a binding agreement between you and FitXray ("we", "us", "our") governing your access to and use of the website fitxray.com and any related services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you must not use the Service.
You must be at least 16 years old (or the age of legal majority in your jurisdiction, if higher) to use the Service. By using FitXray, you represent and warrant that:
FitXray uses artificial intelligence to analyse a photo and information you provide, and generates a personalised workout and nutrition suggestion based on that input.
The Service is provided for general informational and educational purposes. Outputs are generated algorithmically based on visual estimation and self-reported data, and are inherently approximate. We do not guarantee the accuracy, completeness, or suitability of any analysis, recommendation, calorie target, macro target, or exercise suggestion for your specific circumstances.
FitXray, its outputs, and any content provided through the Service are not intended to be, and must not be treated as, medical advice, diagnosis, or treatment. The Service is not a substitute for professional consultation with a licensed physician, registered dietitian, physical therapist, or other qualified healthcare provider.
You should consult a qualified healthcare professional before beginning any new exercise program, making significant changes to your diet, or if you have, or suspect you may have, any medical condition, injury, eating disorder, pregnancy, cardiovascular condition, or other health concern that could be affected by physical activity or dietary changes.
Physical exercise carries inherent risks of injury, including but not limited to musculoskeletal injury, cardiovascular events, and in rare cases, death. By using the Service and following any workout or nutrition guidance provided, you voluntarily and knowingly assume all such risks. You are solely responsible for determining whether any exercise or dietary recommendation is appropriate for your individual health status and physical condition, and for stopping any activity that causes pain, discomfort, or that you believe may be unsafe.
The Service does not screen for food allergies, intolerances, or medical dietary requirements (including but not limited to diabetes, kidney disease, or other conditions requiring a controlled diet). Any calorie, macronutrient, or food-related guidance is general in nature. You are solely responsible for evaluating and adapting any nutrition guidance to your own allergies, intolerances, and medical dietary needs, and for consulting a registered dietitian or physician where appropriate.
The Service is not appropriate for, and should not be used by, individuals with a current or recent history of an eating disorder or disordered eating, or anyone for whom analysis of body composition or calorie/weight-focused guidance could be harmful. If this applies to you, please do not use the Service, and consider speaking with a healthcare provider or a trusted support organisation. Nothing in the Service is intended to encourage excessive exercise, restrictive eating, or an unhealthy relationship with food or body image.

We reserve the right to restrict or terminate access to the Service for any user who violates this section, without notice.
You retain all ownership rights to any photo or information you submit ("User Content"). By submitting User Content, you grant us a limited, non-exclusive, royalty-free license to process that content solely for the purpose of generating your analysis, as described in our Privacy Policy.
As described in our Privacy Policy, photos are processed transiently and are not stored by us after your analysis is generated. You are responsible for retaining your own copy of any results you wish to keep (e.g. via the "Save Plan" feature).
Certain features of the Service may require payment, as indicated at the point of purchase. Prices are displayed prior to purchase and are charged in the currency and amount shown. We reserve the right to change pricing for future purchases at any time; changes will not affect purchases already completed.
All payments are processed by Dodo Payments, a third-party payment processor and Merchant of Record. We do not store your payment card details. Your use of Dodo Payments' services is subject to their own terms and privacy policy (dodopayments.com).
If an analysis fails to generate due to a technical error on our end, you are entitled to a retry or refund for that transaction. To request a refund, contact us at hello@fitxray.com with your transaction details. Refund requests are reviewed on a case-by-case basis. Because the Service delivers a digital output immediately upon generation, refunds are not generally available once an analysis has been successfully delivered, except where required by applicable consumer protection law.
The Service, including its design, text, graphics, logos, branding, software, and underlying technology (excluding your User Content), is owned by FitXray or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of the Service, nor reverse-engineer or attempt to extract the source code of any software used to provide the Service, except where such restrictions are prohibited by law.
The Service relies on third-party providers, including an AI analysis provider (Anthropic), Dodo Payments for payment processing, and Vercel for hosting, as described in our Privacy Policy. We are not responsible for the availability, accuracy, or practices of these third-party services, which are governed by their own terms and policies.
THE SERVICE AND ALL CONTENT, ANALYSES, AND RECOMMENDATIONS PROVIDED THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure, that any AI-generated analysis will be accurate or suitable for your individual circumstances, or that any health, fitness, or body composition outcome will result from following any recommendation provided.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FITXRAY AND ITS OWNERS, OPERATORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:
WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE EXTENT ANY LIABILITY IS NOT VALIDLY EXCLUDED UNDER APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $10.
Some jurisdictions do not allow the exclusion or limitation of certain damages or implied warranties. In such jurisdictions, the above limitations apply only to the extent permitted by law, and our liability will be limited to the maximum extent permissible.
You agree to indemnify, defend, and hold harmless FitXray and its owners, operators, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party, including any privacy or intellectual property right; or (d) any health condition, injury, or adverse outcome resulting from your use of any recommendation provided through the Service.
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service at any time. Provisions of these Terms which by their nature should survive termination (including but not limited to Sections 4, 8, 10, 11, and 12) will survive any termination of your access to the Service.
We may modify, suspend, or discontinue the Service, or any part of it, at any time without liability to you.
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be reflected by updating this page. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which FitXray operates, without regard to its conflict of law provisions, and without prejudice to any mandatory consumer protection rights you may have under the law of your country of residence.
Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith informal negotiation by contacting us at hello@fitxray.com.
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and FitXray regarding the Service and supersede any prior agreements or understandings, whether written or oral.
